Why do I have to pay the employee's legal fees?

It is a legal requirement. For a compromise (settlement) agreement to be valid and waive the employee's right to bring a claim, they must have received independent legal advice. The law stipulates that the employer must make a contribution towards these legal fees. This payment is a necessary investment to ensure the agreement is legally binding.

Can't I just write my own agreement using a template?

This is extremely risky.
